Critical USPTO Maintenance Deadlines

5–6

Years 5–6: Section 8 Declaration

You must file a Declaration of Continued Use (Section 8) between the 5th and 6th anniversaries of your registration date. Missing this window causes your registration to be cancelled.

5+

Year 5+: Section 15 Incontestability (Optional)

After 5 consecutive years of continuous use, you can file for incontestable status, which significantly limits challenges to your registration.

9–10

Years 9–10: Section 8 & 9 Combined Renewal

A combined Section 8 and Section 9 renewal must be filed between the 9th and 10th anniversaries of registration to renew your trademark for another 10 years.

Every 10 Years Thereafter

Combined Section 8 and 9 renewals are required every 10 years for as long as you wish to maintain your trademark registration.

Frequently Asked Questions

If you miss the Section 8 or Section 9 deadline, the USPTO will cancel or expire your trademark registration. There is a 6-month grace period with an additional surcharge, but after that, your registration is permanently lost.
Once a trademark is cancelled for failure to file maintenance documents, you cannot reinstate it. You would need to file a brand new application, losing your original priority date and potentially facing new conflicts.
We recommend starting at least 6 months before your deadline to ensure time to gather a proper specimen and address any issues. We will contact you 12 months in advance as a courtesy reminder.
